The Act repeals the Transnational Organized Crime (Prevention and Control) Act, 2011 (Act 2011-3) in order to make fuller provision for the prevention of the trafficking in persons and the implementation of the United Nations Protocol to Prevent, Suppress and Punish Trafficking in Persons, Especially Women and Children, supplementing the United Nations Convention Against Transnational Organized Crime.

The Act broadens the scope of the offences by creating an offence where trafficking in persons takes place within the country and creates a special offence with heavier penalties in relation to the trafficking of children.

This Act repeals the 1941 Act on Control of Begging. Makes begging in the street an offence.Sections 6 to 12 stipulate the competent authorities to deal with the control of begging and sets out their responsibilities and duties. Section 13 provides that begging is to be prohibited, sets out the definition of begging and provides for exceptions. Makes it an offence to force anyone to beg. Under section 23, all offenses are punishable with imprisonment not exceeding one month and/or a ten thousand baht fine. Penalties for traffickers and those seeking to benefit from begging are more severe: prison sentences of up to three years and fines as high as 30,000 baht. Government officials found complicit face more extreme punishments: up to five years in jail and/or up to 50,000 baht in fines.

The Proclamation contains seven parts and 50 articles. It defines the offence of trafficking in persons, assisting and facilitating trafficking in persons as well as smuggling migrants. Details the penalties for each of the offences, which are increased when the victim of trafficking or smuggling is a child, a woman or a person with a disability, or suffers any psychological or physical harm or when the trafficker or smuggler uses drugs, medicine or weapons or is a person in the public service, a civil servant or a recidivist.

Consent cannot be used as a defence if the victim is a child or if the consent was obtained, inter alia, by a means of threat, coercion, abduction, fraud, deception, abuse of power or by using the vulnerability or by giving or receiving bribe or benefits to achieve the consent of a person having control over another person.

The Proclamation also sets out procedures for the investigation of smuggling and trafficking offences as well as establishing procedures for the protection and rehabilitation of victims of trafficking. It establishes a Fund to prevent, control and rehabilitate victims of crime of trafficking in human and smuggling of migrants and establishes a national committee to oversee the implementation of the law.

Repeals Articles 243, 596, 597, 598, 599 and 635 of the Criminal Code of the Federal Democratic Republic of Ethiopia.

The present Law prevails over the Laws N° 87(I) of 2007 and 13(I) of 2012 on the Legal Framework regulating the Special Protection of Persons who are Victims of Trafficking and Exploitation.

Italy - Elimination of forced labour - Regulation, Decree, Ordinance

Décret législatif n° 24 du 4 mars 2014 portant exécution de la Directive 2011/36/UE du Parlement européen et du Conseil du 5 avril 2011 concernant la prévention de la traite des êtres humains et la lutte contre ce phénomène ainsi que la protection des victimes et remplaçant la décision-cadre 2002/629/JAI du Conseil. (Decreto legislativo 4 marzo 2014, n. 24: Attuazione della direttiva 2011/36/UE, relativa alla prevenzione e alla repressione della tratta di esseri umani e alla protezione delle vittime, che sostituisce la decisione quadro 2002/629/GAI.) -

Modifie le Code pénal (articles 600 et 601) le Code de Procédure pénale (article 398), la loi n° 228 du 11 août 2003 portant mesures contre la traite des personnes (articles 12 et 13), le décret législatif n° 286 du 25 juillet 1998 portant réglementation de l'immigration et de la condition des étrangers (article 18), et le décret législatif n° 25 du 28 janvier 2008 (article 32) dans le but de mettre ces textes en accord avec ladite directive.

Botswana - Elimination of forced labour - Law, Act

Anti Human Trafficking Act, 2014 (Act No. 32 of 2014). -

The Act establishes an Human Trafficking (Prohibition) Committee which is to oversee the implementation of the Act. Prohibits human trafficking, puts in place protective measures for the victims of human trafficking including the setting up of specific centres and the creation of a human trafficking victim fund.
